Palm Tree Insurance Agency offers a text messaging program to provide updates on your account activity, as well as information about our products, services, and promotions (collectively, the “Palm Tree Insurance Agency Program”). We may use standard or automated telephone dialing systems (“Auto-dialers”) to deliver these messages. You agree not to use the Palm Tree Insurance Agency Program for any unlawful purposes. Please note that coverage cannot be bound or amended via text message.

Cost

How to Opt-In

You agree not to initiate messages to any other person or entity’s mobile phone. You also agree to maintain accurate, complete, and up-to-date information with Palm Tree Insurance Agency, including notifying us in writing immediately if you change or cease being the regular user of your mobile number. You agree to indemnify Palm Tree Insurance Agency in full for all claims, expenses, damages, and costs—including reasonable attorneys’ fees—arising from your failure to notify us of such changes, including claims under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq.

Eligibility
To receive text messages or enroll in the Palm Tree Insurance Agency Program, you must be a U.S. resident, at least 18 years old, and authorized to enroll the mobile number and incur any associated charges. Palm Tree Insurance Agency reserves the right to require proof of eligibility.
Changes to These SMS/Text Messaging Terms & Conditions
Palm Tree Insurance Agency may revise these Terms & Conditions at any time. Changes take effect upon posting to our website. Continued participation in the program indicates your acceptance of any changes.
Amendment: Termination of Text Messaging
Palm Tree Insurance Agency may suspend or terminate your participation if you breach these Terms & Conditions or if your mobile service lapses. We reserve the right to modify or discontinue the program at any time, with or without notice.
Release; No Warranties; Limitation of Liability
By participating, you release Palm Tree Insurance Agency and its affiliates from any liability for loss, damage, or injury—including property damage, personal injury, or death—arising from your use of the program. The program is provided “as is” without warranties of any kind. Palm Tree Insurance Agency disclaims all implied warranties, including merchantability and fitness for a particular purpose.
In no event shall Palm Tree Insurance Agency be liable for any damages exceeding $10.00, regardless of the legal theory.
Arbitration/Class Action Waiver
All disputes arising from or related to these Terms & Conditions or the Palm Tree Insurance Agency Program must be resolved by binding arbitration under the AAA Consumer Arbitration Rules. Arbitration will be conducted by a sole arbitrator selected from the national panel. No class or collective actions are permitted. The arbitrator’s decision is final and binding, and judgment may be entered in any court of competent jurisdiction.
Attorney Fees
If Palm Tree Insurance Agency prevails in any dispute, it is entitled to recover all costs, including reasonable attorneys’ fees and arbitration expenses.
Applicable Law
These Terms & Conditions shall be governed by the laws of the State of [INSERT PREFERRED STATE], without regard to conflict of law principles.
